Arbitration and ADR services

In the world of global commerce, disputes are inevitable.  As they occur, parties have options, and the choices they make as to how they seek to resolve those disputes can have enormous consequences, not only in terms of outcome (who wins or loses), but also in terms of the time and costs to achieve.

Chuck Ragan has more than 20 years of experience serving as a neutral and independent arbitrator, mediator and evaluator of commercial disputes, and more than 30 years of experience as counsel in international arbitration and domestic ADR matters.

Chuck is certified as an Arbitrator, Early Neutral Evaluator, and Mediator. He has been listed on the International, Commercial, and Large and Complex panels of the American Arbitration Association for many years.  He also is on panels sponsored by the U.S. Council for International Business (ICC); the Silicon Valley Arbitration & Mediation Center Tech List; FedArb, Inc.; the Chicago International Dispute Resolution Association; and the American College of e-Neutrals (acesin.com).

Recent illustrative appointments include:

  • Party-appointed wing arbitrator in dispute over termination of international distribution arranegment;
  • Sole arbitrator appointed to resolve dispute over termination of international distribution agreement and charges gray marketing
  • Party-appointed wing arbitrator in dispute concerning milestone payments following acquisition of medical device firm;
  • Sole arbitrator through hearings and awards in several ICDR and AAA matters

In his practice at Pillsbury, Chuck was also heavily involved in the design and implementation of a variety of novel ADR processes tailored to meet the needs of particular situations, including international disputes with clients of disparate backgrounds.  For example, he has:

  • Tailored mini-trial procedures to accommodate distinctions of culture and legal systems, which led to the resolution of a sensitive product toxicology dispute among American and Japanese joint venturers
  • Crafted a two-stage protocol for the successful resolution of a nine-figure dispute among a consortium of utilities and a natural resource producer, which concluded in one-third of the time and at a tenth of the cost required for court adjudication of a similar dispute
  • Lectured on international dispute resolution, including ADR, through the International Development Law Institute (Rome, Italy)
  • Chaired a subcommittee of the International Bar Association devoted to mediation and ADR (1996-2000)
